2007 Magical Season of Giving
Official Rules & Regulations

These rules apply to all WestShore Plaza Magical Season of Giving events and/or drawings ("Official Rules"). Participants agree to abide by these Official Rules and by the decisions of WestShore Plaza, whose decisions are final. Failure to comply with these rules may result in disqualification from any WestShore Plaza events and/or drawings. WestShore Plaza reserves the right to permanently disqualify from any of its events and/or drawings any participant WestShore Plaza believes has violated these Official Rules. WestShore Plaza reserves the right to modify or amend these Official Rules, as it deems necessary, with or without notice, at any time and for any reason.

1.      Each dollar spent at WestShore Plaza from 11/15/07 – 12/15/07 will equal one point for the non-profit organization of your choice.  Customers must present receipts to Guest Services from any store or restaurant at WestShore Plaza.  Qualifying receipts are on purchases made from November 15, 2007 to December 15, 2007, ONLY, and MUST BE FROM a retailer at WestShore Plaza.           

2. Purchases made on designated Double Point Days at the designated retailer(s)– not necessarily receipts that are turned in on those designated Double Point Days, qualify for double points.  WestShore Plaza Gift Card purchases count as double points during the promotion.

3. Receipts may only be used one time and will be marked when presented to Guest Services.  The receipt must be the original.  Duplicate receipts, photo copies, faxes and internet orders will not be accepted.  All receipts must be redeemed by 10:00pm on Saturday, December 15, 2007.

4. Purchases of faxes and photo copies cannot be redeemed for points.  Credit Card payments, even if made to a store at the mall, will not be accepted for points either.

5. Store employees may not request, or copy, receipts from store customers in order to redeem them for points.  Additionally, stores (or store employees) may not hold receipts to give to participating organizations to redeem for points.  Solicitation of stores by participating organizations, unless sanctioned through mall activities, to hold receipts for such participating organizations is also prohibited.

6. Receipts are only valid from WestShore Plaza retailers and restaurants.

7. Each dollar spent equals 1 point.   Any less than $.50 will be rounded down to the nearest dollar, and anything equal to or greater than $.50 will be rounded up to the nearest dollar (Ex. $10.45 = 10 points and $10.56 = 11 points).  Double points will be given if the purchase was made on a designated Double Point Day at a designated retailer, or for WestShore Plaza gift cards.

8. An in-mall progress chart will be updated weekly with the participating organizations ranking only.  The final point totals will not be calculated until the final week and will not be posted in the mall. Winners will be notified by certified mail and phone within 14 days of the end of the contest. Points will be combined with those at University Mall to determine the winning organizations as this is a joint promotion between the two malls.  Point totals will not be given to organizations or participants.

9. Any public or private 501(c)3 non-profit organization in the state of Florida is eligible to participate, excluding schools.

10. At the end of the promotion – the participating organizations with the highest points will win cash prizes: 
                1^st place           $7500
                2^nd place          $5000
                3^rd place           $3000
                4^th place           $2500
                5^th place           $2000
                6-10^th place      $1000 each
    In the event of a tie for prize winning points for participating organizations as described in this section, WestShore Plaza will make the final decision regarding any dispute.

11. WestShore Plaza reserves, in its sole discretion, the right to refuse suspicious or fraudulent receipts, or any receipt transactions breaking the above rules.

12. How To Enter Prize Drawings for Individuals

NO PURCHASE OR DONATION NECESSARY TO ENTER ANY DRAWINGS AND/OR RECEIVE ANY PRIZES.

To enter any drawing, each entrant shall follow any one of the following procedures:

(i)          Entrant may obtain an entry form by presenting a receipt to Guest Services from any store at WESTSHORE PLAZA for purchases made from 11/15/07 to 12/15/07. Limit one entry per person per day.

OR,

(ii)         Entrant may request a prize drawing entry form from Guest Services, complete the entry form and deposit it with Guest Services at any time prior to 12/15/07;

OR,

(iii)        Entrant may send a mail-in entry to WESTSHORE PLAZA.  To do so, entrant shall legibly print or type on a 3 1/2 “ x 5” card entrant’s first and last name, address, daytime telephone number, date of birth, e-mail address (if available), and the words “WESTSHORE PLAZA MSOG Drawing”.  Entrant shall send the card, via U.S. Mail, to WESTSHORE PLAZA 250 WestShore Plaza, Tampa, FL 33609.  Limited to one (1) entry per household per day as set forth herein.  No mechanically reproduced entries allowed.  Mail-in entries must be postmarked no later than 12/8/07.  Mail-in entries without the required information will not be accepted.  WESTSHORE PLAZA is not responsible for any late, lost, stolen, misdirected, mutilated, postage-due, illegible or incomplete entries or for address changes of entrants.

13. Drawings and:

A.  Promotion Deadlines
The Start Time of all promotions will be 10:00am on Thursday,11/15/07.  The End Time of all drawings will be 9pm on Saturday, 12/15/07. Mail-In Entrants: Mail-in entries must be postmarked no later than 12/8/07.

B.  Drawings
Drawings for each prize will take place at WESTSHORE PLAZA on Monday, 12/17/07. The drawing will be conducted by WESTSHORE PLAZA or its designee, whose decisions are final and binding on all matters relating to the drawing.  Winners will be selected at random from all eligible entrants.

C.  Notification
Winning entrants need not be present at time of drawing to claim prize.  Winners will be notified by certified mail within 14 days of the drawing for prizes at a value of $250 or more.  Return of any prize notification as undeliverable will be forfeited and an alternate winner will be selected. 

D. Acceptance of Prize
Winning entrants must claim prizes by signing and returning an affidavit of eligibility and release from liability which must be received by WESTSHORE PLAZA within fourteen (14) days of the date of the notification, or the prize will be forfeited and an alternate winner will be selected.  Return of any prize notification as undeliverable will be forfeited and an alternate winner will be selected.  To claim a prize, WESTSHORE PLAZA may require any entrant to present photo identification.  In the event a vehicle is awarded, WESTSHORE PLAZA will require proof of valid U.S. driver’s license and liability insurance before prize is awarded.  All prizes non-refundable, non-transferable and not redeemable for cash.  Each winner is responsible for all federal, state and local taxes applicable to the acceptance and use of his/her prize.

E.  Odds of Winning in Drawings

The odds of winning depend upon the number of entrants received and, therefore, cannot be determined in advance.

F.  Prizes/Individual Prizes:

   A complete prize list will be available at the Central Prize Drawing location in the (Located at Geust Services) throughout 4 week event.

13.  The names of the winners ("Winners List") will be posted at WestShore Plaza’s Guest Services within thirty days of the events and will remain posted there through 60 days. Each entrant also gives consent to release their first name, last initial to be posted on mall’s website.  A Winners List may also be obtained by requesting a Winners List via U.S. Mail to WestShore Plaza within thirty days of the events. All requests must include a self-addressed, stamped envelope and be postmarked no later than January 16, 2008; otherwise, the request will not be accepted. Mail requests to Winners List at WestShore Plaza, 250 WestShore Plaza, Tampa, FL 33612.                                         

14.  VOID IN ANY JURISDICTION IN THE UNITED STATES WHERE PARTICIPATION IS PROHIBITED. WESTSHORE PLAZA RESERVES THE RIGHT TO DISQUALIFY AN ENTRANT THAT IT BELIEVES HAS VIOLATED THE LAWS OF THE JURISDICTION IN WHICH THE ENTRANT RESIDES AND/OR THE EVENT WAS HELD.

15.  The winning organization and (individuals of prizes) agrees to release WestShore Plaza; Glimcher Realty Trust, Glimcher Properties Limited Partnership, Glimcher Properties Corporation, Somerock REIT Sub, LLC, Somerock University Mall/WestShore Plaza Holdings, LLC, Somerock University Mall/WestShore Plaza Mezz, LLC, Somera Investment Partners, LLC, SCM University Mall/WestShore Plaza Investors, LLC, Rockwood VII REIT, Inc, their respective agents, affiliates, employees, partners, suppliers and advertising, promotional or judging agencies, from any and all liability whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the prize or while preparing for participation in and/or traveling to any prize-related activity.  The winning organization may be required to sign an affidavit/disclaimer and tax forms.  The winning organization will be notified when the appropriate forms need to be signed. The winning organizations consent to the use of their name, logo and/or likeness for advertising and publicity purposes without notice or compensation, unless prohibited by law.  Prizes are subject to all applicable federal, state and local laws and regulations. Each winning organization is responsible for all federal, state and local taxes applicable to the acceptance and use of such prize.  All other associated fees, costs, surcharges and expenses not specified herein are also the responsibility of the winning organization, including but not limited to shipping and handling costs. WestShore Plaza may substitute an advertised prize with another prize of equal or greater value, with or without notice, if the advertised prize is unavailable to.
